Re:  Pothole damage to 2011 Kia Soul                                      Sent US Mail – Certified – Return Receipt Requested

March 19, 2018

Dear Sir or Madam:

On Saturday, March 10, 2018, at approximately 1:00 PM, I was traveling East on Old Lake Shore Road in front of Bennett Beach in the Town of Evans on County Highway CR111, when my KIA SOUL submerged into series of multiple potholes, with the last hole being the deepest one.  I was traveling approximately 25 MPH and broke as soon as I seen the holes.

My car immediately started to clank and I thought it might have been a muffler clamp but then a piece of curved heavy metal flew out of my car, which I retrieved.

On the same date, I called the Town of Evans Police and spoke with Dispatcher Conti and reported this damage incident and potholes. He referred me to the County of Erie stating that it was a County road.  A copy of said public incident report is obtainable if needed.  I also went back and took pictures of the potholes should you require them.

I had the car towed on Monday morning to Frank C’s Truck and Auto Specialties, Inc. for repair, who advised that it was a coil that broke off hitting the pothole.  I have attached a copy of the repair bill and payment.  I was 6 days without a vehicle as I could not afford a rental.

I called this office on Monday morning, March 12, 2018 and left a message regarding said potholes and again on Tuesday, March 13 and reported said potholes and incident, stressing how dangerous these potholes are, especially being right in front of the parking lot for Bennett Beach, which is used on a daily basis by families with children and pets.

I am on Social Security Disability, live alone, and cannot afford these unnecessary damages.  I am still paying off this vehicle.

I respectfully request a refund from the County of Erie for the damage to my vehicle.

Should you require any further documentation, please feel free to call or contact me.

Respectfully yours,

Josephine J. Pustulka
